1. Who provides the service

The Spelling Cube is supplied by Michael Nelson, a sole trader trading as darklingspy games, not a registered company ("we", "us"). You contract with Michael Nelson for access to this spelling-practice service. Payments are sold and processed by Paddle as described below.

2. Using The Spelling Cube

By using or continuing to use the service, you agree to these terms. Parent accounts and purchases are for adults aged 18 or over. Children may practise under the responsibility of their parent or guardian; they do not create accounts. If acting for an organisation, you must have authority to bind it.

Keep parent sign-in details confidential and your account information accurate. Your Parent Pass grants a limited, non-exclusive, non-transferable right to use the app for its intended educational purpose.

3. Trial, subscriptions and payments

The free trial lasts seven days from activation and unlocks the whole app. It requires no payment card and does not automatically become a paid subscription. Subscribing starts paid access immediately, including if you subscribe during a trial.

The Parent Pass is £2.99 per month or £18.99 per year, including VAT. Subscriptions renew automatically until cancelled. Cancel renewal in your parent account; access continues until the end of the paid period. Monthly/annual plan changes take effect at renewal, with no immediate charge.

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

4. Acceptable use

Do not use the service unlawfully, for fraud or spam, or to infringe intellectual property or privacy rights. Do not introduce malware, probe or interfere with security, scrape the service, bypass technical limits, reverse engineer it where prohibited by law, or resell it without permission.

Do not submit illegal, abusive, hateful or sexually exploitative content, deepfakes, malware instructions, or attempts to bypass the AI helper's safeguards. Only submit spelling-related handwriting and lists you have the right to use; avoid names or sensitive personal information.

5. Intellectual property and the AI helper

We retain ownership of the service's software, documentation and branding. You retain any rights you have in submitted handwriting, lists and resulting content; we do not claim ownership of those inputs or outputs. You grant us permission to process submitted content solely to provide, protect and maintain the service. AI outputs may not qualify for intellectual property protection.

You are responsible for your inputs, having the necessary rights, checking the accuracy of outputs and how you use them. Recognition and feedback may be inaccurate. The app is a practice aid, not an official assessment or a substitute for teaching or regulated professional advice.

We may refuse or filter outputs, remove or restrict content, or suspend accounts for misuse. Rights holders may report suspected infringement to darklingspy@gmail.com; identify the work and disputed content. We may remove infringing content and terminate access for repeated infringement.

6. Availability and suspension

We aim to keep the app working but cannot guarantee uninterrupted or error-free performance, or compatibility with every device. We may suspend or terminate access for material breach, non-payment, security or fraud risks, or serious or repeated policy violations.

Child progress is stored on the device. Clearing browser data, changing devices or losing a device can remove it; we cannot restore that local data.

7. Your legal rights and changes

Nothing in these terms excludes mandatory consumer rights or liability that cannot lawfully be excluded, including liability for fraud or death or personal injury caused by negligence. We may update these terms and will give reasonable notice of material changes affecting a paid service.
